Results of the Ratification Vote on April 16, 2014

Changes to the Collective Bargaining Agreement between the University of South Florida Board of Trustees and Florida Public Employees Council 79 AFSCME for the years 2011-2014 have been RATIFIED by the majority of the bargaining unit members who participated in Wednesday’s vote.

The purpose of the vote is to accept or reject the proposed changes to two (2) articles of the CBA for FY 2011-2014. The changes to the CBA are as follows:

Article 21: Wages

  • One-time base pay increase of $600 to employees who earn up to and including $41,400.
  • One-time base pay increase of $1,000 to employees who earn more than $41,400.

To be eligible:

  • Employees must have no “Needs Improvement” or “Unsatisfactory on evaluations as of October 1, 2013.
  • Employees must have been continuously employed in an established position on or before September 1, 2013.
  • Employees with less than a 1.0 FTE will receive a prorated amount based upon their FTE.

The market salary adjustments will be issued within 60 days of ratification of this agreement by USF Board of Trustees.

  • One-time lump sum bonuses of $600 to eligible bargaining unit members will be distributed in accordance with a University bonus plan consistent with Florida Statues payable in June 2014.

Article 17: Leaves of Absence/Holidays:

  • Sick Leave Buy-Back – Employees with vested sick-leave benefits can request a one-time cash payment of their sick leave in exchange for giving up a payout upon separation from the University. Sick leave will continue to accrue for use as paid time off only.
  • Employees hired on or after 01/01/2014 will not be paid for any accrued sick leave when their employment ends.
  • Employees hired before 01/01/2014 that have ten (10) years of service upon separation from the University will experience no change to their sick leave payout, but will be paid in accordance with Section (12) (d) of University Regulation 10.203, which pays employees with 10 or more years of service one-fourth of accrued unused sick leave up to a total of 480 hours at the employee’s regular rate of pay at the time of the leave pay out.

All employees in the bargaining unit who are covered by the proposed agreement are eligible to vote, regardless of their membership or non-membership in the Union. To vote, identification will be needed.

The majority of votes cast will determine the ratification of the articles. A copy of the proposed agreement will be available at each voting site.

Meeting April 3, 2014 at 12 noon!

Thursday, April 3, 2014 will be our first monthly lunch hour meeting which will be held in the Music building at the Music Conference Center.   We will be having regular meetings on the first Thursday of the month at 12 noon AND on the third Thursday of the month at 5:15 pm to find out which is best for the most people.  Tomorrow will be our first lunch time meeting so plan to attend!

Collective Bargaining Outcome

From AFSCME 3342 collective bargaining team:

Just as today’s impasse hearing was about to begin, USF management offered a deal on the sick leave payout proposal that the staff union negotiating team decided to accept as the best possible outcome for the vast majority of current bargaining unit employees—the exception being those workers hired after January 1, 2014.

As a result, we were able to preserve the sick leave payout benefit of current employees (except the above-mentioned), without their being subjected to the proposed freezing of the payout amount at their January 1, 2014 rate of pay.  Instead, all current staff employees, those already vested and those who reach vesting before separating from University employment, will have their sick leave payout benefit preserved without any change.

Unfortunately, management held firm that anyone hired after January 1, 2014, will receive no sick leave payout benefit at the end of their University careers, whether vested or not.

Finally, the Early Sick Leave Payout proposal remains as initially proposed.  Vested workers can VOLUNTARILY be paid now for 25% of their sick leave up to a maximum of 480 hours, at only 50 cents on the dollar of the available benefit, and they will then lose the right to cash out again upon separation.

The hearing on the issues at impasse between USF management and the staff union will most likely be over by noon.

In-unit USF staff are strongly encouraged to attend.

IMPORTANT: Please be aware that the University will not allow you to be absent from your job to attend this hearing UNLESS you have the permission of your supervisor. You can use break time or annual leave time.

University management is proposing the following 3 changes to our right to be paid for our leftover sick leave upon leaving USF employment:

  1. CURRENT EMPLOYEES will be paid out at their current level of pay (as of January, 1, 2014) regardless of any raises, promotions or changes of position achieved after that date.
  2. CURRENT EMPLOYEES can choose to be paid for their sick leave now, but those who do will lose the right to be paid for any future sick leave they accrue.
  3. FUTURE EMPLOYEES will unconditionally lose the right to be paid for any accumulated sick leave ever—the permanent loss of a benefit we’ve enjoyed for over 50 years.
